A legal document filed on April 2 contains a newly updated list of the people suing and those being sued about misburials and mishandling of corpses at the Galilee Memorial Gardens in Bartlett.
The “First Amended Class Action Complaint” was filed in Shelby County Circuit Court by Nahon, Saharovich & Trotz, PLC, (NST Law) the largest plaintiffs’ personal injury firm based in Tennessee. The complaint names several additional defendants in the Galilee Memorial Gardens Cemetery matter. To see all 47 pages full of names, dates and details in the amended complaint, click here. NST is seeking class-action status for a $225 million lawsuit against the individuals and entities allegedly involved in misdeeds at the cemetery.
The firm’s class-action complaint include claims of:
- Breach of contract
- Breach of fiduciary duty
- Negligent misrepresentation
- Negligence
- Negligent entrustment
- Intentional interference with a corpse
- Negligent interference with a corpse
- Intentional infliction of emotional distress
- Negligent infliction of emotional distress
- Unjust enrichment
NST Law is currently investigating claims against Galilee and the funeral homes that did business with Galilee after Dec. 31, 2010, when Galilee lost its Tennessee license.
March 28 ruling in Nashville
A Nashville judge ruled on March 28 that legal teams seeking class-action status in lawsuits against Galilee may not interfere with the work of David Kustoff, who was appointed deputy receiver in the state’s takeover of the cemetery. Click here for more details.
